REGARDING YOUR PROPERTY:


Q:  Why are they asking me for a modification in my cell tower lease agreement?

A:  Many times the Carrier or Cell Tower Company will want to modify the agreement so they can add equipment or fiber to the site.  This is a good opportunity to negotiate additional revenue.


Q: How do I get them to repair my easement driveway?

A:  The cell tower lease will dictate who is responsible for the maintenance of the easement areas.


Q:  How can I get a Cell Tower on my Property?

A:  Getting a Cell Tower on your property is not easy.  It involves many aspects, which would take a long time to explain.  Cell Tower Leases only provides services for existing cell tower sites or recently proposed sites.


REGARDING YOUR CELL TOWER LEASE:


Q:  How much is my cell tower lease worth?

A:  in most cases, it can be worth anywhere from $25,000 to over $1,000,000.  Each site has to be individually analyzed.


Q: If my cell tower may go away, then why do they want to buy it?

A:  Companies who own thousands of sites have a much lower risk than someone who owns only one or two.  These companies reduce their risks through numbers.


Q: Why do they want a perpetual easement on my land?

A:  A perpetual easement gives them the right to keep the cell tower operational on your land indefinitely.  Leaseholder should exercise caution.


Q: Why do these companies want to buyout my lease?

A.  There are many reasons why companies want to buy these assets.  In some cases, it is in the leaseholders best interest to sell and in others not.


Q:  What is a NDA agreement?

A:  This agreement is usually required if a leaseholder wishes to sell their lease and a mortgage or lien is on the property.


REGARDING A NEW TOWER ON YOUR LAND


Q:  Why are they asking for a 30-year lease?

A:  These companies like to lock in a long-term rate due to the large expense of building a cell tower.  This is why it is essential to negotiate a fair lease upfront.


Q:  How do I know I am getting a fair rental rate?

A:  These are commercial leases.  There is no "consumer protection”.  It is assumed you are an expert and know what you are signing.  These documents are very one-sided and it is up to each individual to negotiate a fair lease.


Q:  How will a cell tower affect my land value?

A:  In most cases, it will increase the value or have little affect on the land value if the lease is structured properly.
